2. Records façade renovation of facades

The Community Board, by unanimous vote of members present gives the following grants for facade cleaning and restoration work:
FERNANDO M. RUFF, 14 Stundwiller STREET, 67250 Aschbach. Grant amount: 300.00 € uros (work done by force account).
FISCHER OLIVIER - 53 MAIN STREET - 67250 Stundwiller. Grant amount: 840,00 € uros.
LAWRENCE M. BUHLER - 168 A STREET STADIUM - 67,690 Rittershoffen. Grant amount: € 029.00 a uros.

3. SCOTAN changes in the statute

The President informed of changes in the scope of SCOTAN as follows:

The joint association of territorial coherence scheme of Alsace NORTH (SCOTAN) was created by a decree of the prefect of the Lower Rhine dated December 16, 2003.

Following the accession of MERTZWILLER to the community of communes of the Pays de NIEDERBRONN-LES-BAINS, the prefect of the Lower Rhine has taken a first modification of trade union rules by an order dated October 3, 2005.

Following the creation of the association of local SAUER-Pechelbronn, the prefect of the Lower Rhine adopted a second amendment of trade union rules by an order dated April 3, 2008.

The joint communities of HAGUENAU REGION AT THE CROSSROADS and THE THREE CROSSES that each member of the union were mixed SCoTAN be the first in January 2012 a new community of communes of the REGION HAGUENAU. Moreover, the common Bitschhoffen join, 1 January 2012 also, the community of communes of the Val de Moder.

These developments of communities of common members of the joint association require a change in union status to update the list of union members mixed and correspondingly redefine the composition of the union committee.

Representation will be maintained in force with one hand, the delegates in respect of each member of municipalities, and secondly, the delegates under the population of each community member. However, not to question the current geographical distribution of seats on the union committee, the statutes limit over a quarter of the seats the maximum number of seats which a community may have.

The Community Board is therefore asked to rule on the modification of the union constitution SCOTAN mixed.

Given the urban planning code, in particular Articles L. 122-3 and L. 122-4,
Given the general code of local authorities, in particular Articles L. 5711-1 to L. 5211-41-1, L. 5212-1 to L. 5212-34 and L. 5711-1,
Given the prefectural order dated 19 December 2001 fixing the expanded scope of the future scheme of territorial coherence NORTHERN ALSACE,
Given the prefectural order dated 16 December 2003 establishing the joint association of territorial coherence scheme of Alsace NORTH
Given the prefectural order dated October 3, 2005 concerning amendment of the union constitution of mixed territorial coherence scheme of Alsace NORTH
Given the prefectural order dated April 3, 2008 concerning the second amendment of the union constitution of mixed territorial coherence scheme of Alsace NORTH

On the proposal of the President, the Community Board, by unanimous vote of members present with one abstention,

  • approves the amendment of the union constitution of mixed territorial coherence scheme of Alsace NORTH annexed to this decision, regarding the new distribution of seats on the union committee,
  • Instructs the President of the corresponding formalities

4. Management Centre: uptake of services in electronic data acts

Given Law n ° 2004-809 of 13 August 2004 on local freedoms and responsibilities;

Considering Decree No. 2005-324 of 7 April 2005 concerning the electronic transmission of documents of local authorities under the control of legality and amending the regulatory part of the general code of local government;

Given the General Code of Territorial Communities and in particular Articles L2131-1 L3131-1 L4141-1 and;
Considering the resolution dated April 28, 2009 mandating the Management Centre of FPT of the Lower Rhine to proceed with the consultation of a third party remote transmission to the transmission of documents in judicial review by cloud;

Considering that the municipality wishes to engage in paperless transmission of its decisions subject to judicial review in the prefecture,

Whereas after consultation within the Procurement Code Management Center of the Lower Rhine retained CDC-FAST to be the third transmission services;

Proposed by the President,

The Community Council, by unanimous vote of members present and represented,

  • Decides to conduct remote transmission acts to judicial review;
  • Agrees that the Chairman sign the membership agreement with CDC-FAST Services for remote instruments subject to judicial review;
  • Agrees that the Chairman sign the agreement for implementation of the remote transmission of instruments subject to judicial review with the Prefecture of the Bas-Rhin, representing the State for this purpose;
  • Agrees that the Chairman sign the subscription agreement between the Community of communes Hattgau and CDC-FAST;

5. Garbage: pricing and conditions of payment of the royalty OM 2012

SMICTOM communicated the amount of the charge of OM for 2012 accountable by the CDC Hattgau up to 695 € 494.00, an increase of 2.5% over 2011.
The Community Council, following extensive debate, the members present unanimously decides:

  • maintain billing once the fee for 2012 with a payment due March 15, 2012
  • to appear in front of the invoice marked: "You have the option to apply for a structured settlement with the Treasurer Mr Soultz-sous-forest"
  • to apply the tariff according to the table below which reflects the impact of the increase of 2.5% SMICTOM
  • to see if the nursing home Betschdorf will be subject to this fee. Decision postponed by one year for further investigation.
  • make application to the Treasurer to see if it is possible to use a private company to revive the deadbeats.

6. Project kindergarten / after-school to Aschbach

Approval of the companies had been deferred from the meeting of Community Board 29 November 2011 on the basis of a study of thermal project on the basis of the new regulation RT 2012.

Given the response of the architect-mail dated 20/12/2011, the Board unanimously by members present:

  • Decides to keep the project in the state holding that the technical characteristics used are sufficient to guarantee a ranking THPE (very high energy efficiency) and that any additional costs (of around 20%) do not justify the inclusion of a delay embodiment.

7. Various

PLU 7.1

December 12, 2011 held a working meeting between the board and PLU
the public persons involved to present the current status
PLU and especially zoning.
Two major requests were made by the PPA:

  • The total surface areas of activity should not exceed 30 ha
    allocated by the SCOTAN
  • The total area dedicated to the extension housing must be of the order of 37ha to 47ha currently. We are invited to work with existing intramural potential analysis by village. The proposed zoning and Aschbach Oberroedern are especially to be reviewed.

On 19 December, the commission conducted a debriefing:

  • Activity areas have been revised as follows:
    • 20-22ha in Betschdorf (final perimeter is to refine the south of the existing area and residual area south of the street Bannholz
    • Both serviced areas belonging to the town of Hatten for a total area of ​​8.2 ha in the industrial area Rothsmatt be taken into account. The CDC must give its approval for interested companies to negotiate directly with the town of Hatten (economic competence is the responsibility of the CDC).
    • The proposed area of ​​6.5 ha west of the industrial area is abandoned
    • The proposed commercial area west of Hatten was abandoned following the agreement with the CDC to conduct a study Soultzerland opportunity shopping area in need throughout Soultz / Betschdorf / Hatten. Would remain an embryonic area around the existing supermarket (to be defined by the town of Hatten).
  • Level of habitat: the villages are invited to review the potential intramural.
